By accessing or using the website at stocktonasphaltpavingcompany.com (the "Site") or by engaging Stockton Asphalt Paving Company (the "Company") for services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this Site or engage our services. We may update these terms from time to time. Your continued use of the Site or services after any changes constitutes acceptance of the revised terms.
Stockton Asphalt Paving Company is a licensed asphalt paving contractor based in Stockton, CA. We provide paving, sealcoating, repair, striping, grading, and related services to residential and commercial property owners in the Central Valley. Services are performed by our crews or qualified subcontractors and are subject to availability within our service area.
All estimates provided by the Company are based on an on-site assessment of the project area. Estimates are valid for 30 days from the date of issuance unless otherwise stated in writing.
Prices may change if site conditions differ materially from what was observed during the estimate visit, if the scope of work changes at the customer's request, or if material costs change significantly between the estimate date and the project start date. Any changes to scope or price will be communicated to the customer in writing before additional work proceeds.
Submitting a contact or estimate request form on this Site does not constitute a binding agreement. A binding agreement is formed only when both parties have signed a written proposal or contract.
Job scheduling is confirmed in writing after a signed proposal is received. We will make reasonable efforts to begin work on the agreed date, but project start dates may be affected by weather, material availability, or other factors outside our control. We will notify you as promptly as possible of any scheduling changes.
If you need to cancel or reschedule a confirmed project, please contact us as early as possible. Cancellations made after materials have been ordered or crews have been scheduled may result in a cancellation fee, the details of which will be specified in the project contract.
Payment terms are outlined in each project proposal. Unless otherwise agreed in writing, payment is due upon completion of work. For larger commercial projects, a deposit may be required before work begins, with the balance due upon completion or per a schedule specified in the contract.
Invoices not paid within the timeframe specified in your contract may be subject to a late fee. The Company reserves the right to pursue collection of unpaid balances, including reasonable attorneys' fees and costs, to the extent permitted by law.
The Company warrants that all work will be performed in a professional manner consistent with industry standards. Specific warranty terms, including duration and coverage, are stated in each project proposal or contract. Warranties apply to workmanship and materials supplied by the Company and do not cover damage caused by factors outside our control, including acts of nature, improper use, vehicular damage, or failure of existing sub-base conditions not disclosed or discovered prior to the project.
No warranty is implied beyond what is expressly stated in the written project contract.
You agree to provide accurate information when requesting an estimate or booking services. You are responsible for ensuring the project area is accessible on the scheduled work date, including clearing vehicles, equipment, or other items from the work area prior to the crew's arrival.
Failure to provide clear access on the scheduled date may result in rescheduling and, in some cases, a mobilization fee. Any conditions on or below the surface that were not visible during the estimate visit - such as buried utilities, unmarked drainage lines, or unstable base layers - should be disclosed before work begins.
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or your use of this Site, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to a specific project shall not exceed the total amount paid by you for that project. Nothing in these terms limits our liability for gross negligence or intentional misconduct.
